WIPO: 11833.com gehört DTAG

Die Deutsche Telekom AG (DTAG) hat vor dem Arbitration and Mediation Center der World Intellectual Property Organization (WIPO) in dem Streit um die Domain "11833.com" obsiegt (Urt v. 22.12.2003 - Case No. D2003-0893).

Die DTAG nutzt die Rufnummer 11833 in Deutschland für ihre Auskunft und hat auch entsprechende nationale Markenrechte eingetragen.

Der Gegner ist neben "11833.com" auch Besitzer der Domains "11833.info" und "11833.org".

Die DTAG berief sich hier insbesondere auf ihr bestehendes Markenrecht und auf den Umstand, dass die Domain-Beantragung durch den Gegner in bösem Glauben geschah:

"The Complainant contends that the Domain Name is identical to a trade mark in which it has rights and provides proof of a German trade mark registration for the mark 11833.

The Complainant also contends that the Respondent has no rights or legitimate interests in respect of the Domain Name. (...)

The Complainant further contends that the Domain Name was registered in bad faith and is being used in bad faith (...)."

Auf all diese Umstände brauchte das Arbitration and Mediation Center gar nicht weiter eingehen, denn der Gegner antwortete nicht, so dass schon alleine aus prozessualen Gründen von der Bösgläubigkeit der Domain-Registrierung ausgegangen wurde.
